TERMS AND CONDITIONS OF BUSINESS

COMMUNICATION

All contact with Stamford Cycleworks about any issue must be made via email or telephone. Social media or other such channels are not continuously monitored and as such any messages conveyed to us through these means will not be deemed to be official and may not be acted upon.

PRICES
  1. All prices quoted by SCW for parts and labour are based on the prices current at the time of preparing the estimate and SCW reserves the right to increase such prices to the Customer. All estimates for work to be done are valid only at the time at which the estimate is first communicated to the Customer.
  2. Unless otherwise stated all prices are inclusive of VAT and all prices are subject to VAT at the current rate.
  3. Payments for parts reserved or ordered must be made in advance.
  4. Interest at the rate of 10% will accrue on overdue accounts per month or part thereof from the date of invoice payment due.
WARRANTY & GUARANTEES

SCW will use its reasonable endeavours to make over the benefit of any warranty or guarantee given by the manufacturer or supplier of any parts supplied to the customer.

Within a period of ten days from the completion of any service or repairs provided by SCW to the Customer, SCW will rectify free of charge all labour which is proved to the satisfaction of SCW to have been defective. Where the Customer deals as a consumer (within section 12 of the Unfair Contract Terms Act (UCTA) 1977) these guarantees are given in addition to the Customers statutory rights.

In no circumstances will SCW or its servants, agents or sub-contractors be liable for any loss or damage of any kind whatsoever (except arising from death or personal injury established to be caused by SCW’s negligence) whether consequential or otherwise, caused directly or indirectly, by any negligence on the part of SCW or on the part of any of its servants, agents or sub-contractors in connection with or arising out of the provisions of services or supply of parts or in connection with any advice or statement given or made on behalf of SCW.

Stamford Cycleworks issues no warranties on bikes or bike parts. For all goods supplied please refer to the manufacturers warranty, on the individual manufacturers website.  Should a product fail within its guarantee period due to a manufacturing defect, you must return it to us for inspection in the first instance.  This is invalidated should if you or a third party carry out any remedial action without our prior authorisation.

Compatibility of products is not guaranteed. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Goods are only supplied for intended use, SCW cannot accept responsibility for any item or product used out-with its intended use or for use in competition.

PRE-OWNED BIKE SALES - WARRANTY & RETURNS

All our pre-owned are sold as seen and do not routinely come with warranty. However, some bikes may be supplied with a warranty set and agreed with the buyer in writing at the time of purchase.  All pre-owned bikes have been fully reconditioned by an accredited mechanic. We sell them as fully roadworthy and safe.

A discretionary warranty covers all mechanical faults.

Your discretionary warranty does not cover:

  • Punctures.
  • Failure due to usual wear and tear.
  • Failure due to poor maintenance of the bicycle, e.g. if the chain has not been oiled, a part has been taken off and put back on incorrectly, etc.
  • Accidents or tampering with the bicycle.

In all cases where the fault is covered bya discretionary warranty we will endeavour to make good the problem.

Refunds for bike purchases are subject to a restocking/repair charge. This is 15% of the sale price. Refunds remain at our discretion.

Our returns policy complies with your statutory rights under the consumer rights act 2015.

TITLE AND RISK

The Customer’s bicycle, bag, its contents (where submitted with the bicycle) and accessories shall at all times remain at the Customer’s entire risk whilst in the possession of SCW.

The property in any part supplied will not pass to the Customer until all sums due from the Customer to SCW (whether under this contract or otherwise) have been paid in full.

The risk in any property or parts supplied shall pass on delivery to the Customer.

BIKE PICK UP AND DELIVERY

All reasonable care will be taken to ensure the safe pick-up and delivery of customers’ bikes.

Once collected bikes are deemed in the possession of SCW and subject to the clauses under “Title and Risk” above.

Costs for this service will be provided at the time of booking.

Donated Bikes

Stamford Cycleworks accepts donations of bikes subject to our discretion.

If assessed as econmically viable, they will be repaired, serviced and sold.  We will donate 5% of the proft to our nominated charity (after labour, parts, postage and listing fees have been deducted).

If assessed as not econmically viable to repair, parts will be salvaged to be used on other bike restorations and the remainder recycled through the appropriate chanels.

FAULT INSPECTION

Where the Customer requests SCW to investigate any fault or complaint with the Customer’s bicycle SCW will endeavour to contact the Customer before proceeding with any work or repairs found to be necessary but shall be under no obligation so to do.

SCW is hereby authorised to carry out all work but supply such parts, as it deems necessary in its sole judgement to rectify the fault or complaint.

PARTS

Returns for credit  will not be accepted unless SCW ‘s previous consent has been obtained and either (a) a claim under manufacturer’s warranty is involved or (b) parts proved incorrect and not to order, or (c) SCW expressly agrees to accept the returns for credit subject to a handling charge 0f 20% of the net price.

Quoted prices for parts are liable to change without notification if altered by the manufacturer or supplier and are subject to VAT at the current rate. Agreed part replacements must be paid for on order.

SCW will endeavour to deliver parts ordered within the time agreed and if no time is agreed within a reasonable time but in no circumstances will SCW be liable for loss or damage of any kind whatsoever caused directly or indirectly by any delay in the delivery of any parts, nor will any such delay entitle the Customer to cancel or rescind the contract.

Unless otherwise agreed, delivery will be made at SCW premises and the contract price is based on that basis.

No drawings, descriptive matter, dimensions or  specifications issued by SCW or the manufacturer of the parts nor descriptions or illustrations contained in SCW ‘s or manufacturers catalogues, price lists or other advertising matter shall be deemed to form part of the contract nor be regarded as a warrant or representation relating to the parts.

If the Customer defaults in accepting delivery of or paying for the parts ordered, SCW reserves the right to re-sell the parts to a third party without giving notice to the Customer of SCW’s intention to re-sell.

Parts supplied to the Customer special order will not be accepted for credit unless they are defective.

SERVICE AND REPAIR

While carrying out work requested by the Customer, SCW may discover that in the interest of safety and satisfactory completion of the work requested, additional repair work appears necessary.

In such cases, SCW will promptly contact the Customer to obtain approval for carrying out the additional work and thus save the Customer possible extra costs by reason of possible subsequent further dismantling and re-assembly at a later date.

In the event that the customer cannot be contacted in a timely fashion, all work save the supply of parts can be completed and charged for. All work done and parts/materials supplied will be charged on completion.

Release of the Customer’s bicycle after completion of repairs will be subject to our charges having been paid in full by cash or by credit/debit bank card.

Without prejudice to these terms and conditions SCW agrees to give the Customer the benefit of any manufacturer’s warranty as far as SCW is able.

SCW will progress any claims on behalf of the Customer with the manufacturer concerned, but in the event of claims being rejected in whole or in part, the Customer undertakes to pay SCW that part of the claim the manufacturer fails to meet.

Where claims are submitted to the manufacturer for work to be treated as being of a warranty nature, although strictly outside the warranty period, payment in full for the work carried out will be required on or before collecting the bicycle on the understanding that should the manufacturer subsequently accept the claim in full or in part, SCW will as appropriate, either reimburse the Customer’s account with the amount credited to us by the manufacturer for any purpose whatsoever.

SCW does not accept responsibility or liability for any delay in completion of works carried out by SCW caused by circumstances beyond its control.

If the Customer does not collect the bicycle within five working days of being notified that it is ready for collection or fails to authorise repairs without removing the relevant bicycle from SCW ‘s premises within 14 days of being given a quotation then SCW reserves the right to levy storage charges at the current rate.

Any bicycle or part thereof which is not collected by the Customer in respect of which payment for repairs carried out had not been made within three calendar months of the Customer having been advised of the completion of the work may be sold by SCW and the cost of repairs and any storage charges may be deducted from the net proceeds of the sale of the bicycle or parts.

However, before proceeding to sell the bicycle, SCW shall first give the Customer 7 days written notice of its intention so to do which notice shall be sent by pre-paid first class post to the address of the Customer last known to us and shall be deemed to have been received by the Customer on the days following the date of the posting or if that shall be a Sunday or public holiday then the first working day thereafter.

Any sale of a bicycle or part thereof under this clause shall be by any means deemed appropriate and SCW shall, after discharging the costs of the sale, the repairs and storage charges, in its absolute discretion either retain the balance for a period of one week for the benefit of the Customer or forward the same to the Customer at the Customer’s last known address.

In the event of a defect arising following completion of the works and which, in SCW ‘s sole opinion is due to substandard workmanship, SCW will carry out the necessary work free of charge subject to:

  1. The Customer returning the bicycle to SCW within 1 week for examination and the agreement that the defect was the result of substandard labour.
  2. No alteration or repair has been affected by the Customer; and
  3. The defect occurring within 10 working days from the date of completion of the work. If SCW is not contacted as soon as is reasonably practicable after the alleged defect arising, SCW reserves the right to reject any subsequent claim in respect of a defect which is alleged was due wholly or partly to SCW’s labour.

SCW will use its reasonable endeavours to carry out the work within the time specified but time shall not be of the essence and no liability is accepted by SCW for any delays.

All parts replaced during service or repair, except those that have to be returned to the manufacturers or suppliers under warranty or service exchange arrangements and those which the Customer expressly or by implication asks to be replaced, will be retained by SCW for the Customer until the time when the bicycle is collected by the Customer. If the Customer does not specifically ask to take possession of such replaced parts when collecting the bicycle then they will become the property of SCW to dispose of as it deems fit.

SCW shall have a general lien over all bicycles left with it by the Customer in respect of all money due to SCW from the Customer or owners of the bicycle under this or any other contract.

If at any time the customer decides to cancel the repair, they will be liable to make payment of any parts ordered and a calculation of the cost of labour on a pro rata basis to the maximum of the agreed labour will be charged.

CUSTOM BUILDS, UPGRADES, PRE ORDERS

All pre-orders and deposits are non refundable.

Specific parts for upgrades must be paid for at time of ordering in full. Other ordered parts, not paid for, remain the property of SCW until payment is received.

Restocking charges may be applied to bikes or parts specially ordered and then returned.

Delivery dates may change and you will be notified if this is the case. You will then have the chance to agree to the new delivery date or have a full refund. If you have agreed to the new delivery date then you are agreeing to the terms and conditions and the deposit becomes non refundable once again.

BIKE FITTING SERVICES

“Booking” means any confirmed reservation made with the SCW by whatever means and “Fitting” means the service provided by the SWC

Fees are payable on completion of the Fitting. Fees may alter from those agreed whilst booking as agreed between SCW and Client. Cash, Debit and Credit card can be accepted.

SWC reserves the right to accept, cancel, postpone, alter or delay any booking. The SCW website or any other literature can only be regarded as a guide to the activities performed during the fitting process.

SWC accepts no liability for damage or injury to the Client or their property whilst on the SCW premises or subsequent to the fitting service completion.

It is the responsibility of the Client to advise SCW of any special needs. SCW cannot accept responsibility for such needs unless it has stated in writing that it is able to accommodate those needs.

Bookings are made on the sending of a confirmatory e-mail from SCW to a Client.

Cancellations or Postponements of SCW Fitting sessions:

Confirmed cancellations received via e-mail, or in writing 4 days prior to the date of the fitting incur no charge.

Confirmed cancellations received via e-mail, or in writing less than 4 days prior to the date of the fittings are payable in full unless rebooked within 2 months.

Non attendance at a confirmed booking will be payable in full unless good reason is provided by the Client.

WAIVER & INFORMED CONSENT

Due to the nature of the fitting process undertaken SCW accepts no liability and offers no guarantees for its fitting service.

The Client accepts that any medical conditions or injuries related to cycling must be reviewed by a qualified medical professional and take full responsibility for enacting any changes recommended by SCW.

It is the client’s responsibility to inform SWC of any current or pre-existing medical conditions.By booking a SCW Bike Fit appointment the client accepts that they will be participating in an active session.

In the unlikely event that you need to complain about a product or a particular service please do so by emailing  us at the address below. Please include full details of your complaint including dates and times of contact with us along with copies of any correspondence that we have sent you.

DATA PROTECTION ACT

The information you give us about yourself, the details of this agreement and the history of business conducted between us, will be retained by us on our records.

It will also enable us to tell you about products and services which we think may be of interest to you. You may elect not to receive such information. We may also disclose some or all of the above information to our associate Companies for any purpose connected with our business.

OFFERS & PROMOTIONS

Automated/bulk entries and entries from third parties will be disqualified.

YOUR RIGHTS

 

Stamford Cycleworks (SCW) complies with UK Consumer Law including Consumer Protection (Distance Selling) Regulations 2000. This is the minimum we will do to ensure your experience with SWC is a pleasant one, these terms and conditions do not affect your statutory rights.

Distance Selling Regulations give you the right to return any unwanted goods (with some exceptions) within fourteen days of receiving them providing they are unused and in their original packaging.

REGISTRATION

You warrant that the personal information which you are required to provide on registration is true, accurate, current and complete in all respects; and you are not impersonating any other person or entity.

As a convenience to our customers, the Website may include links to other websites or material which is beyond our control. For your information, we are not responsible for such websites or material nor do we review or endorse them. ORDERS AND CARD SECURITY

All orders placed online are held on our secure server and are encrypted by AlphaSSL.

Once your order is placed, we will email confirmation of the details of your order and keep you informed of the progress of your order by email and/or telephone.

When acknowledgement of your order is received, this indicates that we have received your order. It does not indicate that a contract exists between us. Your order constitutes an offer to SWC to buy goods. All orders are subject to acceptance by SWC. We will confirm acceptance by sending you an email that confirms all of the relevant details of the order. The contract between SCW and you will only be formed when we send you the order confirmation.

We work to ensure represented stock is available. If items ordered become unavailable, we will contact you to suggest an appropriate alternative. If no suitable alternative is available, we will cancel the order.

We reserve the right to cancel the contract between us if:

  • We have insufficient stock to deliver the goods you have ordered; or
  • One of more of the goods you ordered was listed at an incorrect price due to an input error in the pricing information received by us from our suppliers; or
  • We have reason to suspect that there is a risk of a fraudulent transaction; or
  • We are unable to obtain authorised payment or the payment process is incomplete.

We shall accept no liability in respect of any failure to deliver goods you have ordered or any delay in doing so that is caused by any event or circumstance beyond our reasonable control.

We reserve the right to ask for further information regarding the cardholder’s name, address and contact details. If this information is not forthcoming, SCW may choose not to proceed with the order. We reserve this right to protect both you and other bona fide customers.

Any incorrectly ordered purchases which have been invoiced but need refunding will incur an admin charge.

SCW encourage users of this website to post reviews, ask questions and upload images, as long as the content is not illegal, obscene, abusive, invasive of privacy, infringes copyright, or otherwise causes injury to third parties. SCW reserves the right to remove or edit any content if deemed necessary.
